§ 1

General

  1. The Administrator of Personal Data is MIEDZIŃSKI GRUPA KAPITAŁOWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Kowale, Kowale 21, 42-274 Konopiska, KRS: 0000473870.
  2. The protection of personal data is carried out in accordance with the requirements of generally applicable law, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data
    and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as: GDPR), and their storage takes place on secure servers.
  3. For the interpretation of the terms contained in this document, the glossary of the Store Regulations is used, available on the website of the www.miedzinski.pl, in the "Online Shopping Regulations" tab , or as described in this Privacy Policy (if it results directly from the description).
  4. We respect the right to privacy and care about data security. For this purpose, m.in secure communication encryption protocol (SSL) is used.
  5. Personal data provided in the form on the website of the Personal Data Administrator www.mdmenergy.pl, in the "Contact" tab , are treated as confidential and are not visible to unauthorized persons.

§ 2

Scope and purpose of personal data processing

  1. Seller - MIEDZIŃSKI GRUPA KAPITAŁOWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Kowale, Kowale 21, 42-274 Konopiska, KRS: 0000473870, is the Administrator of the Customer's Personal Data. This means that if the Customer has an Account (Customer Account) on our website www.miedzinski.pl, we process such Customer data as: name and surname, e-mail address, telephone number, residential address, delivery address;
  2. Seller - MIEDZIŃSKI GRUPA KAPITAŁOWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Kowale, Kowale 21, 42-274 Konopiska, KRS: 0000473870, is also the Administrator of Personal Data of persons subscribed to the newsletter and persons who have agreed to receive marketing/commercial information and persons who have agreed to profiling.
  3. Personal data is processed:
  1. in accordance with the provisions on the protection of personal data,
  2. in accordance with the implemented Privacy Policy,
  3. to the extent and for the purpose necessary to establish, shape the content of the contract, change or terminate it and its proper implementation (legal basis provision of Article 6(1)(b) of the GDPR),
  4. to the extent and for the purpose necessary to comply with legal obligations incumbent on
    on the Personal Data Administrator (legal basis provision of Article 6(1)(c) of the GDPR),
  5. to the extent and for the purpose necessary for the purposes of the legitimate interests pursued by the Personal Data Administrator and the processing does not violate the interests or fundamental rights and freedoms of the Customer (legal basis provision of Article 6(1)(f) of the GDPR),
  6. to the extent and for a purpose consistent with the consent expressed by the Customer, if he has signed up
    for the newsletter (legal basis, the provision of Article 6(1)(a) of the GDPR),
  7. to the extent and for the purpose consistent with the consent expressed by the Customer, if he has expressed a desire to receive marketing / commercial information (legal basis, the provision of Article 6(1)(a) of the GDPR),
  8. to the extent and for the purpose consistent with the consent expressed by the Customer, if he has expressed a desire to profile (legal basis article 6 (1) (a) of the GDPR).
  1. Personal data is stored for the period necessary to achieve the above-described purposes, whereby:
  1. in the case of performance of the concluded contract - for a period until its completion, and after that time - for the period and to the extent required by law or to secure any claims, and in the case of the Customer's consent to the processing of data after the expiry of the contract -
    until such consent is withdrawn,
  2. in the scope of fulfilling legal obligations incumbent on the Personal Data Administrator in connection with his business activity and the implementation of concluded contracts - for a period until the Personal Data Administrator fulfills these obligations,
  3. in the scope of internal administrative purposes of the Personal Data Administrator - for a period until the legitimate interests of the Personal Data Administrator constituting the basis for processing are fulfilled or until the Customer objects,
  4. in the scope of sending the newsletter, receiving marketing / commercial information and profiling - for a period until the Customer withdraws consent to such processing.

§ 3

Customer Rights

  1. Each data subject has the right to:
  1. access to data on the basis of Article 15 of the GDPR - at any time the Personal Data Subject has the right to request information from the Personal Data Administrator whether personal data concerning him or her are being processed, and if so, he has the right to access these data or obtain a copy thereof. The Personal Data Administrator is obliged to provide relevant information without excessive fees and without undue delay. The deadline for the Administrator to fulfill the request is one month, but not longer than three months - in complicated cases (due to the complicated nature of the request or the number of requests), counting from the date of receipt of the request;
  2. rectification of data pursuant to Article 16 of the GDPR - at any time the Personal Data Subject has the right to request the Personal Data Administrator to rectify the personal data concerning him or her, if he finds irregularities in his personal data collected by this Administrator;
  3. restriction of data processing on the basis of Article 18 of the GDPR - at any time, in the situation described in the provisions on the protection of personal data, the Personal Data Subject may request the Personal Data Administrator to limit the processing of data. If such a request is justified, these data will be processed by the Personal Data Administrator and undertaking any operations other than storage will require a separate consent of this Person, unless the processing is necessary for the protection of claims or rights of another person or due to important reasons of public interest;
  4. the right to object on the basis of Article 21 of the GDPR - in the event of valid, legitimate grounds, the Personal Data Subject may object to the processing to the Personal Data Administrator, invoking the primacy of his interests, rights and freedoms
    over the purpose of data processing;
  5. the right to be forgotten pursuant to Article 17 of the GDPR - at any time, in the situation described in the provisions on the protection of personal data, the Personal Data Subject may request the Personal Data Administrator to immediately delete the personal data concerning him or her and the Personal Data Administrator is obliged to delete these data without undue delay;
  6. the right to data portability pursuant to Article 20 of the GDPR - at any time the Personal Data Subject has the right to request the Personal Data Controller to receive in a structured, commonly used and machine-readable format his or her personal data processed in an automated manner on the basis of his consent or in connection with the performance of a contract;
  7. the right to lodge a complaint to the supervisory body of Art. 77 GDPR - if the Person to whom the personal data relates considers that the processing of personal data by the Personal Data Administrator violates the provisions of the GDPR, the Personal Data Subject has the right to lodge a complaint
    to the supervisory authority;
  8. the right to withdraw consent - in the case where data processing takes place on the basis of the provision of Article 6(1)(a) of the GDPR, i.e. consent
    for the processing of personal data, The Data Subject,
    has the right at any time to apply to the Personal Data Administrator and withdraw the consent given to him for the processing of his personal data. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

  1. We reserve the right to process the Ordering Party's personal data
    after termination of the contract or withdrawal of consent only to the extent necessary to pursue possible claims before a court or if national or EU regulations or international law oblige us to retain data.
  2. The Seller has the right to share the Customer's personal data and other data that he processes with entities authorized under applicable law (e.g. law enforcement authorities).
  3. The Seller does not share personal data outside the European Economic Area.
  4. We have implemented data encryption and have access control in place, thanks to which we minimize the effects of a possible breach of personal data security.
  5. Personal data is processed only by persons authorized by us
    or processors with whom we work closely and with whom we have a contract
    to entrust the processing of personal data.

§ 4

Cookies

  1. The website www.miedzinski.pl and www.mdmenergy.pl use cookies.
    These are small text files sent by a web server and stored
    by the browser computer software. When the browser reconnects to the page, the site recognizes the type of device from which the Customer connects. Parameters allow you to read the information contained in them only to the server that created them. Cookies therefore facilitate the use of previously visited websites.
  2. The information collected relates to the IP address, the type of browser used, the language, the type of operating system, the Internet service provider, the information
    about the time and date, location and information sent to the site via the contact form.
  3. The collected data is used to monitor and check how customers use our websites to improve the functioning of the website, providing more effective and trouble-free navigation. We monitor information about the Customer using the Google Analytics tool, which records the Customer's behavior on the website.
  4. Cookies identify the Customer, which allows you to adjust the content of the website,
    which he uses, for his needs. By remembering his preferences, he allows you to properly match the ads addressed to him. We use cookies to guarantee the highest standard of convenience of our website, and the collected data is used only within our company to optimize operations.
